Suffolk requires every business to complete a three-step sequence — the city’s A-B-C process — before operating legally. Understanding the structure of this process and the one-month penalty deadline is essential before you begin.

The key deadline: Suffolk imposes a 10% late penalty if you do not obtain your business license within one month of starting your business. The penalty clock starts when your business begins operations, not when you submit your application. Complete all three steps before your first day of business.

Step A: Zoning Clearance

Before the Commissioner of Revenue will process your business license, the city must verify that your business type is permitted at your proposed location. This is handled by the Planning and Community Development office.

What to Expect

Planning staff reviews your proposed use against Suffolk’s zoning ordinance for your specific address. The review confirms that your business activity is an allowed use in the zoning district covering your location.

Bring a clear description of your business activity and your business address. The more specific your use description, the faster the review.

Home Occupations

Home-based businesses require zoning clearance the same as commercial locations. You must demonstrate that your business activity qualifies as a permitted home occupation under Suffolk’s zoning standards. Typical home occupation rules limit signage, restrict customer traffic at the residence, cap the number of on-site employees, and prohibit certain types of commercial activity in residential zones.

If Your Use Is Not Permitted

If the Planning Department determines your proposed use is not permitted at your address, you have options: relocate to an address that is properly zoned, or apply for a conditional use permit or rezoning through the Planning Department. Do not proceed to Steps B or C until zoning clearance is confirmed.


Step B: Trade Name Registration

Step B is required only if your business will operate under a name other than your legal entity name or personal legal name.

When Step B is required:

  • You are operating under any name that is not your own last name (for sole proprietors)
  • Your LLC, corporation, or partnership operates under a name different from its registered SCC name

When Step B is exempt:

  • Sole proprietors using a business name that incorporates their own last name
  • LLCs and corporations using their exact registered name

Names using the owner’s last name are exempt from trade name registration.

Bring your identification and the trade name you want to register. You will receive documentation of the trade name registration to bring to Step C.

If your business does not use a trade name, proceed directly from Step A to Step C.


Step C: Business License

With your zoning clearance and trade name registration (if applicable) in hand, you apply for your business license through the Commissioner of Revenue. Suffolk offers two locations:

The North Suffolk branch is well-positioned for businesses in the Harbour View area, the Route 58/460 corridor, and other northern parts of the city. Both locations have equal authority to issue licenses.

All Owners Must Be Present

Every owner of the business must appear in person with a valid DMV-issued photo ID. There are no exceptions. For businesses with multiple owners, all must be physically present at the same appointment.

You can print the business license application online before your visit to review and pre-fill the required information. This reduces time at the counter. Check the Commissioner of Revenue’s section of the city website for the current application form.

  • Zoning clearance from Step A (written confirmation from Planning Department)
  • Trade name registration certificate from Step B (if applicable)

Business License Fee Structure

Minimum Fee

The minimum business license fee in Suffolk is $50. This applies to all businesses with estimated gross receipts under $100,000.

Over $100,000 in Gross Receipts

For businesses projecting gross receipts over $100,000, the fee is calculated as a rate applied to total gross receipts. Virginia sets state cap rates by business classification that localities may not exceed:

The One-Month Penalty: Critical Timing Requirement

Suffolk’s 10% late penalty is assessed if you fail to obtain your business license within one month of the date your business begins operations.

This is a startup compliance penalty specific to new businesses. The calculation:

  • License fee amount × 10% = penalty amount
  • Total due = license fee + penalty

Example: $50 license fee × 10% = $5 penalty. Total due: $55.

For higher-volume businesses, the penalty scales with the license fee. A business paying $500 in license fees would owe an additional $50 penalty.

The only way to avoid this penalty is to complete the A-B-C process and obtain your license before — or no later than one month after — your business start date.


Trust Taxes: Registration and Monthly Remittance

Who Must Register

If your business collects any of the following taxes from customers, you must register with the Commissioner of Revenue BEFORE you begin collecting:

  • Meals tax — collected on prepared food and beverage sales
  • Lodging tax — collected on hotel, motel, and short-term rental stays
  • Admissions tax — collected on charges for entry to events or venues

Registration is handled at the same Commissioner of Revenue offices listed for Step C. Register during your initial Step C appointment if your business is subject to any of these taxes.

Monthly Remittance Deadline

Trust taxes collected from customers must be remitted to the city by the 20th of each month. This is a monthly obligation — NOT quarterly.

Missing the 20th triggers penalties on the outstanding amount. Establish your remittance process before you open so the first month’s remittance is on time.

Example schedule: Taxes collected in April must be remitted by May 20. Taxes collected in May must be remitted by June 20.


Business Personal Property Tax

In addition to the annual business license fee, Suffolk assesses Business Personal Property (BPP) tax on tangible business property — equipment, machinery, furniture, fixtures, computers, and similar assets used in your business operations.

BPP return deadline: May 1 each year

The BPP return lists all taxable business personal property you own as of January 1 of that tax year. The Commissioner of Revenue assesses the tax based on the reported values.

Machinery and Tools Tax

If your business involves manufacturing, processing, mining, or certain other industrial activities, Machinery and Tools (M&T) tax applies separately from BPP. This tax covers equipment used directly in production processes.

M&T return deadline: May 1 — the same deadline as BPP, but filed as a separate return.


Annual Renewal

Suffolk business licenses renew annually. The renewal deadline is March 1.

The renewal process requires you to report your actual prior-year gross receipts and recalculate your fee based on those figures. Your initial application used estimated receipts; renewal uses actual receipts.

You can print the renewal application online in advance. Download it, pre-fill what you can, and bring it to your renewal appointment or follow mailing instructions if available.


Closing Your Business

When you cease operations in Suffolk, file a closing return with the Commissioner of Revenue. Report:

  • Your official closing date
  • Actual gross receipts through the closing date

Notify the Commissioner promptly to stop the accrual of ongoing tax obligations. Ensure that any outstanding trust tax remittances are paid through your closing date — all taxes collected from customers must be remitted regardless of when the business closes.
