Isle of Wight County, Smithfield and Windsor Business License: County Versus Town, April 15 Deadline

Isle of Wight County, Smithfield and Windsor Business License: County Versus Town, April 15 Deadline

If you are opening a business in Isle of Wight County, Virginia, you may need one local license or two, and the answer depends on where the business is physically located. A business inside Smithfield, Virginia or Windsor, Virginia answers to the town instead of the county, and the town calendar can differ. Pick the wrong government and you can file on time with the wrong office and still owe a penalty. This guide covers which license applies, what the published categories cost, and the dates that matter.

Informational disclaimer: This page is informational content, not legal or tax advice. Rates, deadlines, and forms change. Confirm every figure with the office named before you rely on it, and talk with a qualified attorney or CPA if your situation is complex, such as a business with locations in both the county and a town, or an entity choice with tax consequences.

Virginia has no state business license, so plan for the local license

Virginia does not issue a general state business license. The State Corporation Commission (SCC) forms entities such as LLCs and corporations and accepts assumed name filings, but it issues no business license. The general business license is a local tax called the Business, Professional and Occupational License (BPOL), authorized under Va. Code 58.1-3700 et seq. and administered by each city, county or town, usually through the Commissioner of the Revenue.

Not every locality levies a general BPOL tax. Va. Code 58.1-3704 allows a locality to levy none, so do not assume a local license exists everywhere in Virginia. Your job is to check the locality where the business actually operates. Separately, state-regulated trades need a state board license in addition to any local license. Contractor license classes since July 1, 2025 are Class C for work over $1,000 to under $30,000, Class B for $30,000 to under $150,000, and Class A for $150,000 or more. Confirm your class with the Department of Professional and Occupational Regulation (DPOR).

Entity and name filings with the SCC

If you are forming an entity or registering a trade name, these are the SCC costs you will encounter:

FilingFiled withCost
Articles of Organization (Form LLC1011)SCC$100
LLC annual registration feeSCC$50 per year; no annual report
Name reservationSCC$10 for 120 days
Assumed name certificate (DBA)SCC$10, no newspaper publication
Articles of Incorporation (Form SCC619)SCC$75

An assumed name is filed with the SCC, not the circuit court. Virginia entities must also keep a registered agent who is a Virginia resident with a Virginia street address, available during business hours, and who is either a member of the Virginia State Bar or a member, manager, officer, trustee or general partner of the entity. An entity cannot serve as its own agent. Expedited online filing is available for an extra charge: next-day service costs $50 or $100, and same-day service costs $200. Expedited service is nonrefundable.

The question that decides your license: county address or town address

Isle of Wight County, Virginia had an estimated population of 41,321 in Census 2025 figures. Smithfield, Virginia had 9,112 residents and Windsor, Virginia had 2,947. Inside a town that levies a license on the same activity, the town license takes the place of the county license under Va. Code 58.1-3711. A shop inside Smithfield's limits therefore generally pays the town for the general BPOL license, while a farm stand or home office outside town limits pays the county.

Do not decide based on your mailing address. Town and county mailing addresses can look alike, and a Smithfield or Windsor mailing address does not always mean the business sits inside town limits. The county publishes an address-range list that separates town addresses from county addresses. Check it before you apply, and if your address is near a boundary, ask the Commissioner of the Revenue to confirm. Keep in mind that county taxes also apply to town residents, so moving inside a town changes which BPOL license you need but does not remove every county tax.

Isle of Wight County, Virginia: the county license

For a business at a county address, the Isle of Wight County, Virginia Commissioner of the Revenue administers the license. Apply online at lfweb.isleofwightus.net/Forms/BLApp, or contact the office at [email protected] or 757-365-6263. These rules apply:

  • File and pay before your first day of business. The license should be in place when you open, not on the renewal calendar.
  • Get zoning clearance first. Call Central Permitting at 757-365-6211 before you apply. A business license does not override zoning.
  • Confirm the threshold. The county's published position is that a license is required at $25,000 or more in gross receipts. Under $25,000, a license may not be required, and the Commissioner decides based on your Schedule C or 1099 figures. State law also sets a population-based floor for localities of this size, which is $50,000 in gross receipts for localities of 25,000 to 50,000 people. Ask the Commissioner to confirm in writing how the threshold applies to your receipts.
  • Know the minimum fee and rates. Gross receipts under $50,000 pay a $50 minimum fee. At $50,000 and above, the rate depends on your business classification. The category rates are not published in the county materials we found, so get your rate from the Commissioner before budgeting. A news report says the county is at the state maximum rate; reportedly, verify this with the county.
  • Contractors. A county license is needed once permitted work in the county reaches $25,000 in the year.
  • Renewal. Renew by March 1. A late renewal carries a 10% penalty. Business personal property forms are due April 1.

Isle of Wight County VA short-term rental license

The county's application materials expressly tell short-term rental operators that they need a license. Be careful with the term, though. In Virginia BPOL law, short-term rental refers to renting equipment, not renting rooms or homes through a booking platform. If you rent a room or a home, confirm with the Commissioner which category applies to you, and plan for the county's 5% transient tax as well. Lodging and dining also carry separate county taxes: a 6% meals tax, a 5% transient tax, and no admissions tax.

Other county taxes to budget for include personal property at $4.50 per $100 of assessed value and machinery and tools at $1.95 per $100.

Smithfield, Virginia: its own license and an April 15 deadline

Smithfield, Virginia runs its own business license, so a business inside town limits does not renew with the county on March 1. The Smithfield deadline is April 15. Treat that date as the one that matters for town addresses, and build your calendar around it.

Smithfield's license rates are set per $100 of gross receipts for most classes:

Business classRate
Contractors0.10 per $100
Retail0.12 per $100
Professional0.35 per $100
Repair, personal and business services0.20 per $100
Wholesalers0.05 per $100
Every other class$30 minimum

We did not find a published exemption threshold for Smithfield, so confirm with the Treasurer whether a small business owes the license. Other rules:

  • Deadline and penalty. Pay by April 15. A 10% penalty applies after the deadline, and interest of 10% a year runs from May 1.
  • Backup documents. Include a copy of your current Schedule C as backup.
  • Contractors. You need a Smithfield license once your contracting exceeds $25,000 cumulative in a calendar year.
  • Peddlers. A peddler's license costs $500 or $50 a day, depending on the option that fits your activity, so confirm which applies.

The Treasurer's Office is at 310 Institute Street, Smithfield, Virginia 23430 (mailing address P.O. Box 246), and the phone number is 757-365-4200. You can pay by cash, check or card. Ask the office whether you can start or pay online before you plan around it.

Smithfield's town taxes also differ from the county's. The meals tax is 6.25% and the transient tax is 6%, and both returns are filed quarterly, due on the 20th of April, July, October and January. Real estate is taxed at 0.16 and personal property at 1.00, and machinery and tools at 0.375, per $100 of assessed value, which is the standard Virginia unit, so confirm the basis with the Treasurer. Zoning permits cost $30 or $75, a sign permit costs $30, and a special use permit costs $400. Confirm which zoning permit your project needs before you apply.

Windsor, Virginia: its own license

Windsor, Virginia also issues its own business license and uses a home-occupation permit form dated 2020. Windsor's license rates and filing deadlines are not confirmed here, so call the Town of Windsor before you apply. Do not assume that Smithfield's April 15 date or the county's March 1 date applies to you. If you will run the business from your home inside Windsor, ask whether the home-occupation permit applies. Windsor's property tax rates are 0.15 for real estate, 0.50 for personal property, 0.25 for machinery and tools, and 0.50 for merchants' capital.

Sales tax: rural does not mean outside the regional tax

Isle of Wight County, Smithfield and Windsor sit in the 6% Hampton Roads group on the Virginia Department of Taxation's rate table. That 6% combines a 4.3% state rate, a 1.0% local rate and a 0.7% regional rate. Franklin city, Southampton County and Poquoson are also in that group. A rural address does not place a seller outside the regional tax. For the rules that apply across the region, read our Hampton Roads business license guide. Register for a sales tax permit through Virginia Tax at https://www.tax.virginia.gov/sales-and-use-tax.
